1. Data controller
Petra Noir (“we”, “us”) operates petranoir.com and related booking channels. This notice explains how we process personal data when you browse our website, request a quote, subscribe to updates, or contract charter services. Replace this section with your registered trade name, address in Turkey/EU, and company registration details.
2. Scope (GDPR & UK GDPR style)
If you are in the European Economic Area or the United Kingdom, the General Data Protection Regulation (EU) 2016/679 and the UK GDPR (as applicable) grant you rights over your personal data. This policy is structured to reflect Article 13/14 transparency requirements. It is a template only and does not constitute legal advice.
3. Turkish Law (KVKK)
Under Law No. 6698 on the Protection of Personal Data (KVKK), personal data processed in Turkey must be handled lawfully and proportionately. Where Petra Noir processes data in Turkey, we act as data controller unless a separate agreement designates us as processor. Insert your VERBIS registration status, representative (if any), and Turkish contact address when applicable.
4. Categories of data we may collect
- Identity & contact: name, email, phone/WhatsApp, country, language preference.
- Booking & trip planning: travel dates, party size, destination interests, dietary or accessibility notes you choose to share.
- Technical & usage: IP address, device type, approximate region, pages viewed, referrer, cookie identifiers.
- Communications: messages you send via forms, email, or messaging apps.
5. Purposes & legal bases (GDPR)
Depending on context we rely on: contract (preparing or performing a charter), legitimate interests (fraud prevention, site security, analytics in aggregate), or consent (non-essential cookies, marketing where required). Where Turkish law applies, equivalent grounds under KVKK (e.g. explicit consent, performance of contract, legal obligation) should be mapped by your counsel.
6. Cookies & similar technologies
We may use essential cookies for security and language preference, and optional cookies for analytics or marketing if you accept via our banner. You can withdraw consent by clearing cookies and declining non-essential storage. Describe your actual cookie stack (e.g. Google Analytics ID, Meta Pixel) here after audit.
7. Recipients & processors
We may share data with: email/form providers (e.g. Formspree or equivalent), hosting/CDN providers, yacht owners or operational partners strictly to fulfil your request, and professional advisers under confidentiality. List subprocessors and standard contractual clauses (SCCs) for non-EEA transfers when finalised.
8. International transfers
Data may be processed in Turkey, the EU, the UK, or the United States depending on infrastructure. For transfers from the EEA/UK to countries without adequacy decisions, we intend to use appropriate safeguards (SCCs or UK IDTA) as required. Replace with your actual transfer mechanisms.
9. Retention
Enquiry data is kept only as long as needed to respond and pursue legitimate business follow-up, unless law requires longer. Contract and accounting records may be retained for statutory periods (commonly several years in Turkey/EU). Define exact retention tables with your accountant.
10. Your rights
Depending on jurisdiction you may have rights to access, rectify, erase, restrict, port, or object to processing, and to lodge a complaint with a supervisory authority (e.g. Turkish KVKK Board, EU DPA). To exercise rights, contact info@petranoir.com. We will respond within applicable legal time limits.
11. Children
Our services are not directed at children under 16. If you believe a minor has provided data, contact us and we will delete it where required.
12. Security
We use HTTPS, access controls, and reputable service providers. No method of transmission is 100% secure; we encourage strong passwords and caution when sharing travel documents.
13. Changes
We may update this policy to reflect legal or operational changes. Material updates will be indicated by revising the date above. Continued use after changes constitutes notice where permitted by law.
