1. Agreement
These Terms govern use of the Petra Noir website and preliminary communications. A yacht charter becomes binding only when confirmed in a separate charter agreement, invoice, or written confirmation signed or accepted by both parties. Replace party names and registered entity details here.
2. Governing law & jurisdiction
Unless a signed charter states otherwise, these Terms are intended to be interpreted in accordance with the laws of the Republic of Turkey. Disputes arising from website use or non-maritime services may be subject to the courts and execution offices of Istanbul, Turkey (customise venue with your lawyer). Consumers resident in the EU/EEA/UK may have mandatory rights that cannot be waived.
3. Services described
Petra Noir arranges luxury yacht charters and related concierge services as described on petranoir.com. Photographs, specifications, and “from” pricing are indicative; final availability, crew, equipment, and inclusions are confirmed in writing for each booking.
4. Enquiries & accuracy
You agree to provide accurate contact and travel information. We may decline or cancel a booking if information is materially false or if operational or safety requirements are not met.
5. Pricing & payment
Quoted prices depend on season, yacht, duration, VAT or harbour dues, and extras (provisions, transfers, special events). Payment schedules (deposit, balance, APA if any) are defined in your charter contract. Until payment conditions are met, dates are not guaranteed.
6. Cancellation & force majeure
Cancellation fees and rebooking rules follow the charter party agreement and owner/operator policy. Neither party is liable for failure caused by force majeure events (including severe weather, port closures, pandemic restrictions, or war) beyond reasonable control, subject to mandatory consumer laws. Insert your standard percentages and notice periods.
7. Conduct & safety
Guests must follow captain’s instructions and applicable maritime regulations. Dangerous or illegal conduct may result in immediate termination of the charter without refund. Maximum guest counts and safety equipment rules are non-negotiable.
8. Limitation of liability
To the extent permitted by Turkish law and international conventions, Petra Noir’s liability for website use is limited to direct damages and capped at the fees paid for the specific service giving rise to the claim (if any). We are not liable for indirect or consequential loss. This section must be reviewed against Turkish Code of Obligations and consumer protection rules.
9. Intellectual property
Text, images, video, logos, and design on this site belong to Petra Noir or licensors. You may not copy, scrape, or reuse materials for commercial purposes without written permission.
10. Third-party links
Links to Instagram, WhatsApp, payment providers, or partners are provided for convenience. Their terms and privacy practices apply separately.
11. Changes
We may update these Terms by posting a new version on this page. Charter contracts already signed remain governed by their original terms.
